These Terms of Use (“Terms”) govern your access to and use of tweakrix.com, our software products, download flows, subscriptions, support channels, and related services offered by Tweakrix Ltd (collectively, the “Services”).

By accessing the Website, clicking a download button, purchasing, downloading, installing, or using any part of the Services, you agree to these Terms. If you do not agree, you must not use the Services.

These Terms should be read together with our Privacy Policy, Cookie Policy, Refund Policy, and End-User License Agreement. If there is a conflict between these Terms and the EULA regarding the Software itself, the EULA will control for that specific Software-related issue.

1. Definitions

“Tweakrix”, “we”, “us”, “our” means Tweakrix Ltd, the operator of the Website and provider of the Services.
“User”, “you”, “your” means any person or entity accessing or using the Services.
“Software” means Tweakrix software products, including Tweakrix Driver Updater, related installers, updates, and associated software components.
“Payment Provider” means a third-party provider that processes payments, subscriptions, refunds, or billing operations and may act as a Merchant of Record.
“Services” includes the Website, software, download pages, checkout flows, support channels, subscriptions, online features, and related content made available by Tweakrix.

2. Eligibility and Acceptance

You must be legally capable of entering into a binding agreement to use the Services.

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

By using the Services, you also represent that:

you are at least the age required to enter into this agreement under applicable law, or have valid parental or guardian consent where legally required
you will use the Services only in compliance with applicable laws and third-party rights
any information you provide to us or our service providers is accurate and current

3. Scope of the Services

Tweakrix provides software and related online services that may include:

driver scan and review functionality
software downloads and updates
subscription or license-based features
customer support and troubleshooting
informational content, landing pages, and product-related materials

Important notes:

Tweakrix may provide a free scan or limited pre-purchase functionality, depending on the product and plan.
Access to paid features may require an active subscription or paid license.
Driver installations or similar changes require user action and confirmation.
The Services are not antivirus, security, forensic, or professional IT diagnostics services.
Results may vary depending on device state, supported hardware, operating system version, third-party software, and other technical factors.

4. License and Use Restrictions

Subject to your compliance with these Terms and any applicable payment obligations, Tweakrix grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for personal or internal business use on supported devices.

You may not:

copy, modify, translate, or create derivative works of the Software except where expressly permitted by law
reverse engineer, decompile, disassemble, or attempt to derive source code except to the extent required by applicable law
rent, lease, sublicense, resell, or distribute the Software or Services without authorization
bypass technical limitations, licensing mechanisms, or security controls
use the Services in a way that violates law, infringes third-party rights, or interferes with the operation of the Services

5. Payments, Subscriptions, and Billing

5.1 Payment processing

Payments for subscriptions or paid features are processed by one or more third-party Payment Providers, some of which may act as a Merchant of Record depending on product, region, payment method, or checkout flow.

Tweakrix does not collect or store your full payment card number.

5.2 Subscription terms

If you purchase a subscription:

your subscription may renew automatically unless canceled in accordance with the checkout terms
the price, billing cycle, renewal terms, and cancellation method will be shown during checkout or in the purchase confirmation flow
different payment providers may apply different billing procedures depending on your location and payment method

5.3 Cancellation and refunds

Cancellation prevents future renewals but does not automatically entitle you to a refund of prior charges.

Refund eligibility is governed by the applicable checkout terms, payment provider procedures, and our Refund Policy, where applicable.

For billing questions, invoice requests, chargebacks, subscription management, or refunds, you may be required to contact the relevant Payment Provider directly.

6. Service Changes, Availability, and Third Parties

We may release updates, bug fixes, compatibility improvements, pricing changes, or new versions of the Services at any time.

We may also modify, suspend, limit, replace, or discontinue any feature, content source, platform support, support channel, or part of the Services with or without notice, to the maximum extent permitted by law.

Some parts of the Services depend on third-party technologies, hosting, payment systems, analytics providers, or other external services. We do not control these third parties and are not responsible for their availability, performance, security, content, or privacy practices.

The Services may not be available in all countries, regions, languages, operating systems, hardware environments, or device configurations.

7. User Responsibilities

You agree to:

use the Services only on devices you own or are authorized to manage
review scan results, update selections, and product information before making changes
create backups, restore points, or other safeguards where appropriate
follow all applicable laws, platform terms, and third-party requirements
use the Services in good faith and not for abusive, fraudulent, or unlawful purposes

You are responsible for your device configuration, system state, installed software environment, and any actions you choose to take after reviewing information provided by the Services.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, Tweakrix disclaims all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, satisfactory quality, and uninterrupted availability.

We do not warrant that:

the Services will be error-free, uninterrupted, or always available
the Services will meet your specific requirements or expectations
any update, driver suggestion, or software action will resolve a specific issue
the Services will be compatible with all hardware, software, drivers, or operating systems

9. Limitation of Liability

To the maximum extent permitted by law:

Tweakrix shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, loss of profits, loss of revenue, business interruption, loss of business opportunity, or damage to hardware, peripherals, software environments, files, settings, or operating systems.
Our aggregate liability for any matter arising out of or relating to the Services shall be limited to the lower of: (a) US $80; or (b) the amount paid by you for the relevant Services during the 3 months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Intellectual Property

The Website, Services, Software, branding, logos, designs, content, and related materials are owned by Tweakrix or its licensors and are protected by intellectual property laws.

Except for the limited rights expressly granted to you, no ownership or other rights are transferred to you.

11. Privacy

Your use of the Services is also governed by our Privacy Policy and Cookie Policy.

12. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Tweakrix, its affiliates, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

your misuse of the Services
your violation of these Terms
your violation of applicable law or third-party rights
your content, instructions, technical decisions, or actions in connection with the Services

13. Termination

We may suspend or terminate access to the Services if:

you violate these Terms
required by law
necessary for security, abuse prevention, fraud prevention, or operational reasons
continued provision of the Services is no longer commercially, technically, or legally feasible

You may stop using the Services at any time. Termination does not affect provisions that by their nature should survive, including payment obligations, intellectual property protections, indemnification, disclaimers, and limitations of liability.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Israel, without regard to conflict of law principles, unless mandatory consumer protection law requires otherwise.

Subject to applicable consumer protection law, disputes arising from or relating to these Terms shall be subject to the jurisdiction of the competent courts in or for Yokneam Illit, Israel.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, products, pricing, technical functionality, or business operations. The “Effective Date” indicates the latest version.

Your continued use of the Services after updated Terms are posted means you accept the revised Terms, unless applicable law requires a different form of notice or consent.
